The lease requires you to indicate whether electricity, gas and water services are measured separately for the rented property. For all water faucets manufactured from 2005, it is easier to verify that they meet the required efficiency standards, to search for products with a WELS rating of three stars or more. WELS is the water efficiency labelling system in Australia, which evaluates faucets such as faucets, shower heads and toilets based on water efficiency – the more stars, the better. Water differs from other distribution companies because it is always connected, and the account for the water supply will be in the owner`s name. We cannot give advice on the amount of water consumption to be included in a lease agreement, since that is the landlord`s decision. As a general guide, the average water consumption per person living in our watershed is about 168 litres per day. Since all the water consumed is attributable to your tenant, you can share the cost of the water bill to encourage the tenant to water the lawns and gardens. With the prescribed tenancy agreement, you can determine the percentage of water consumption that the tenant must pay.
Some suppliers calculate wastewater based on the amount of water they provide. The landlord can ask the tenant to pay for the wastewater they produce. Your rental agreement details the tenant`s obligations for water billing and the frequency of these fees. If the leased property is powered by electricity or gas by an on-board network, owners or brokers must include it in the lease. This applies only to leases signed from March 23, 2020. At the beginning of the tenancy agreement, landlords/agents and tenants should negotiate agreements on water charges and the frequency of royalties. The presence of effective devices on the water must be recorded in the entry report (form 1a). A dosed water supply allows a water supplier to calculate the amount of water consumed. This is necessary to continue the water supply of the premises. Receipts from certain suppliers are considered to be supporting documentation, i.e.

There is a « general guarantee » that a lease will be maintained if a tenant recovers the costs of using or supplying water or if a repayment plan is followed. If a tenant is more than 14 days late with water consumption or incidental fees, the landlord or real estate agent can be served with no payment notice that gives him 14 days to leave the property. In the case of Varghese v Liang-Huang (Tenancy)  NSWCTTT 973, the premises had a telephone outlet. The tenant assumed that there was a fixed network that was working, but there was none. The court found that the lessor is responsible for providing a fixed network, except in the case of a specific exclusion in the lease. The general maintenance of the pump is the responsibility of the owner. If tenants damage the pump (z.B by running the pump when the tank is empty), they may be responsible for the repair costs. The owner must give written instructions on how the supply water system works.
